1. Acceptance of Terms
By accessing or using the NovaArc platform and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. NovaArc, Inc. ("NovaArc," "we," or "us") reserves the right to modify these Terms at any time.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at security@novaarc.app if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations.
- Generate, distribute, or store malware, exploits, or other harmful code.
- Attempt to gain unauthorized access to the Service or other users' accounts.
- Reverse engineer, decompile, or disassemble any portion of the Service.
- Use the Service to send unsolicited communications (spam).
- Resell or sublicense the Service without our express written consent.
5. Intellectual Property
The Service and its original content, features, and functionality are owned by NovaArc and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you create using the Service, subject to the license grant below.
6. License Grant
You grant NovaArc a non-exclusive, worldwide, royalty-free license to use, reproduce, and process content you submit to the Service solely to provide and improve the Service. This license does not transfer ownership of your content.
7. Token Usage & Billing
Paid plans are billed in advance on a monthly or annual basis. Token allocations reset at the start of each billing period. Unused tokens do not carry over. All fees are non-refundable except where required by law or at our sole discretion.
8. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. NovaArc does not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate or suitable for any particular purpose.
9. Limitation of Liability
To the maximum extent permitted by law, NovaArc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amounts paid by you to NovaArc in the twelve months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
